EU POSTED WORKER / SOCIAL SECURITY CERTIFICATES

EU/EFTA law contains a number of mandatory provisions regarding the working and employment conditions of posted workers. A "posted worker" is an employee sent by their employer to another EU/EFTA country to provide a service there for limited duration of stay. The provisions are intended to regulate rights and conditions throughout Europe and thus avoid "social dumping". Relevant regulations are outlined in the Posting of Workers Directive (96/71/EC) adopted in 1996, which has been transposed into national law by each member state.

The notification of employees posted within the EU has been mandatory since June 2016. Increased checks are already being carried out in Austria, France, Luxembourg, Switzerland, Spain and Italy. Failure to comply and / or failure to report can result in multiple penalties: fines, temporary work bans in the respective country and inclusion of the company on the "blacklist" are possible consequences.
